The Platform helps property owners connect with participating estate agents for free market assessments and property related enquiries.
The Platform does not:
- act as an estate agency
- provide legal advice
- provide financial advice
- provide formal property valuations
- guarantee property values or sale prices
3. Market Assessment Disclaimer
Any market assessment, estimated value, automated value, or property information provided through the Platform is for informational purposes only.
It is not:
- a professional valuation
- a bank valuation
- a municipal valuation
- investment advice
- legal advice
Consumers should obtain independent professional advice before making property decisions.
4. No Agency Relationship
ValueAProperty.com is not the consumer’s estate agent.
Any agreement, mandate, listing, valuation appointment, or transaction is strictly between the consumer and the participating estate agent or agency.
We are not responsible for:
- agent conduct
- property advice
- valuations supplied by agents
- negotiations
- commissions
- property transactions
- failed sales
5. Consumer Responsibilities
Consumers agree to:
- provide accurate information
- only submit genuine enquiries
- not impersonate another person
- not submit false or misleading information
- use the Platform lawfully
6. Consent to Contact
By submitting your details through the Platform, you consent to being contacted regarding your enquiry by:
- ValueAProperty.com
- participating agents
- related service providers assisting with the enquiry
Communication may occur through phone, email, SMS, WhatsApp, or other reasonable communication channels.
Consumers may opt out of marketing communication at any time.
7. CPA and POPIA Compliance
All agents, agencies, advertisers, and users are independently responsible for complying with all applicable South African laws, including:
- Consumer Protection Act
- Protection of Personal Information Act
- Electronic Communications and Transactions Act
- Property Practitioners Act
- PPRA requirements
Agents are responsible for ensuring their own compliance with direct marketing laws, consent requirements, opt out requests, consumer protection rules, advertising laws, and data protection obligations.
The responsibility for lawful direct marketing rests entirely with the agent or advertiser using the Platform.
8. Agent Responsibilities
Agents and agencies using the Platform confirm that:
- they are legally entitled to operate
- they hold any required registrations or certificates
- their information is accurate
- they will comply with all applicable laws
- they will treat consumers fairly
- they will not use misleading advertising
- they will not misuse lead information
Agents must ensure that all communication and advertising complies with CPA and POPIA requirements.
9. Lead Usage
Leads supplied through the Platform may only be used for responding to the specific consumer enquiry.
Agents may not:
- resell leads
- share leads unlawfully
- add consumers to unrelated marketing lists without consent
- continue contacting consumers after opt out requests
Agents are responsible for securely storing and lawfully handling personal information.
10. Lead Routing
The Platform may assign or route enquiries based on QR codes, referral links, area allocation, campaigns, subscription status, and operational requirements.
We do not guarantee exclusive leads unless agreed in writing.
11. Advertising Rules
Agents are responsible for all advertising and claims made through the Platform.
Agents may not:
- make false claims
- imply guaranteed sale prices
- provide misleading valuations
- use deceptive marketing
- breach advertising laws
We may remove or suspend content at our discretion.
12. Fees and Subscriptions
Where paid subscriptions or services are offered:
- fees are payable in advance
- pricing will be shown before signup
- failed payments may result in suspension
Unless required by law, fees already paid are non refundable.
13. No Guarantee of Results
We do not guarantee lead volume, lead quality, property sales, commission, advertising performance, or uninterrupted service.
All services are provided on an as available basis.
14. Prohibited Use
Users may not:
- scrape data
- reverse engineer the Platform
- upload malicious code
- misuse lead information
- send spam
- breach CPA or POPIA
- interfere with the Platform
- engage in unlawful conduct
15. Intellectual Property
All Platform branding, software, systems, content, and materials remain the property of ValueAProperty.com unless otherwise stated.
No content may be copied or distributed without permission.
16. Privacy
Personal information is handled according to our Privacy Policy.
Agents receiving lead information are independently responsible for complying with POPIA.
17. Third Party Services
We may use third party providers including hosting, analytics, payment, messaging, and marketing services.
We are not responsible for third party systems or outages.
18. Suspension and Termination
We may suspend or terminate access if these Terms are breached, unlawful conduct is suspected, abuse or spam occurs, or where required by law.
Users may stop using the Platform at any time.
19. Limitation of Liability
To the maximum extent allowed by law:
- we are not liable for indirect or consequential damages
- we are not liable for lost profits or lost business
- we are not liable for agent conduct or services
- we are not liable for property transactions or valuation accuracy
Where liability cannot legally be excluded, our total liability is limited to R1000.
20. Indemnity
Users agree to indemnify ValueAProperty.com against claims arising from:
- misuse of the Platform
- unlawful marketing
- POPIA breaches
- CPA breaches
- misleading advertising
- unlawful handling of personal information
- breach of these Terms
21. Changes to Terms
We may update these Terms from time to time.
Continued use of the Platform means acceptance of the updated Terms.
22. Governing Law
These Terms are governed by the laws of South Africa.
Any disputes will be handled in South African courts.
